The scheme is timely as new regulations relating to
the Age Discrimination Act come into force from October
2006. The Act, while protecting the rights of employees,
will give all employers new obligations to consider and
constitute a longer employment period. Specifically, a
national default retirement age of 65 will be
introduced, making compulsory retirement below age 65
unlawful (unless objectively justified). All employees
will have the 'right to request' to work beyond the
default retirement age of 65 and all employers will have
a 'duty to consider' requests from employees to work
beyond 65, ultimately impacting on overall employment
costs.
