It's the biggest shake up of fire safety legislation in the last
thirty years and few people seem to be aware of it!
On the 1st October 2006 the Regulatory Reform (Fire Safety) Order
2005 came into force.
If you control premises either as an owner or tenant, a new set of
regulations now affects YOU.
Every business in England and Wales with 5 or more employees is
required by law to carry out and record a fire risk assessment; act on
the findings of the assessment; and train all staff in basic fire
safety. 
The act firmly places a duty on the Responsible Person (person with
control over the premises), and outlines all the measures that must be
taken to ensure the safety of all the people they are responsible for.
At the same time it allows the Enforcement Authority (usually the Fire
Service) to make sure that it is enacted and sets penalties if it is
not.
The responsible person now must carry out a Fire Risk Assessment,
produce a Policy, develop Procedures (particularly evacuation), provide
training and carry out fire drills.
The foundation of the Act is the Risk Assessment. This must be
reviewed regularly and if necessary amended. The Risk Assessment must be
formally recorded if the responsible person employs 5 or more people.
The HSE and the Fire & Rescue Service may carry out a spot check on
your company, and if you haven't carried out (and recorded) a fire risk
assessment you will be breaking the law and liable to prosecution.
Not only is it an offence not to have a fire risk assessment, you may
find that you are not covered by your insurance, which could put your
business at serious risk.
